What can we expect in this underage DUI charge?

My 17 year old daughter was arrested for a DUI this weekend. According to her, she had a blood alcohol level of .03 and had only 2 drinks prior to driving. What kind of charges can we expect?

A person under 21 is considered under the influence if they have a blood alcohol level of 0.02. She can be charged with driving under the influence and being under 21. There can be additional charges for being under 18. Contact me to go over the facts and have me help her to decide what to do.

The DUI consequences for a minor in court should be minimal- maybe dismissed. But the DMV is another matter. She will probably lose her license for a year.

You already know the charges: Driving Under the Influence, DUI. The outcome and sentencing depend upon the facts, evidence, testimony, etc, that is available for your attorney to use. If this is a first DUI offense, and there was no accident involved, there probably will be no additional jail time, but unless you win at trial or could get it dismissed somehow [not likely normally], she faces substantial fines, alcohol school, and probation. It is the attorneys goal to minimize the damage.

Keep in mind: If you were charged with DUI, then upon release from jail or booking, you will be given documents that include a notice from DMV that you have only ten days to file a request with DMV for a hearing on an appeal of the automatic one-year suspension of your license. Contact DMV and do so, timely. You can hire an attorney for that hearing if you want.
