If you cannot afford an attorney, you have the right to have representation appointed by the court. A domestic violence charge could be a misdemeanor or a felony. In either situation, you're entitled to a public defender if you financially qualify.

Domestic Violence (PC 273.5) can be charged as a misdemeanor or a felony, in either case you are entitled to representation. If you choose to not hire an attorney and are found to qualify for the services of the Public Defender, their office would be appointed (or another attorney from a similar office or a Conflict Panel, in case of the PD's office having a conflict.) Good luck!

Depends. You have to fill out an asset declaration. Based on your ability to pay for an attorney, the Judge will determine whether you are eligible for a PD.

If you questions is CAN you get a public defender for your domestic violence charges, the answer is 'it depends'. Under the United States and California Constitutions, you have a right to an attorney; if you cannot afford an attorney, one will be appointed to you. The qualifying factor in that statement is 'afford'. A Public Defender will only be appointed if you do not have the means to pay for a private attorney.
